New legislation regarding the sale of homes with wood-burning stoves from before 2003
Effective date: 01.08.2021
This information has been prepared based on the Ministry of Environment and Food's press material regarding the upcoming legislation concerning the sale of homes with installed wood-burning stoves. However, we must make reservations for the content of the text, as the final legal text may deviate from the ministry's issued press material.
The law, adopted by the Danish Parliament, aims to reduce particle emissions. With the law, it is mandatory to replace or decommission an old wood-burning stove from before 2003 (31.12.2002) when a property is traded (house, apartment or summer house).
The new rules in the change of ownership scheme are valid from the 1. August 2021. The home buyer is then obliged to state whether there is an old wood-burning stove from before 2003 in the home they have bought when the deed is registered. It is the buyer's responsibility to report and document the age of the wood-burning stove upon registration of the deed. Replacement or sealing must take place within 12 months.

BR18 – Applicable rules for installation and assembly of chimneys
Effective date: 01.07.2018
When you are to place your new wood-burning stove in the room, you must be aware that the chimney's safety distance may be greater than the wood-burning stove's safety distance.
As a general rule, you can place the wood-burning stove directly against the wall if you do not have combustible walls. However, we always recommend a distance of 5 to 10 cm from the wood-burning stove to the wall. However, it is often the chimney's safety distance that means the wood-burning stove must be placed further away from the wall.
On 01-07-2018, the new building regulation BR18 came into force, according to BR18, there are changed requirements for the installation of chimneys. The changes are significant when the chimney is installed near combustible material, e.g. a wooden wall or door frames by a door.
